These terms and conditions apply when you purchase a refurbished device, accessory or bundle (each a "Product") from Envirofone through our website at envirofone.com (the "Site"). Please read them carefully before placing your order. By submitting an order you agree to be bound by these terms, together with our Privacy Policy and any additional service specific terms we draw to your attention.
Envirofone is a trading name of James Johnson Green Limited, registered in England and Wales with company number 10452936 and registered office at Unit 37a Sisna Park Road, Plymouth, Devon, PL6 7FH. References to "Envirofone", "we", "us" and "our" are to James Johnson Green Limited. References to "you" and "your" are to the person placing the order for Products.
Orders can be placed through the Site or over the phone with our customer services team. When you place an order, you are making an offer to purchase Products in accordance with these terms. We will send an email acknowledging receipt of your order, but a binding contract is only formed when we dispatch the Products and send you a dispatch confirmation email. We reserve the right to refuse any order, including where a Product is out of stock, there is an unexpected limitation on our resources, we cannot authorise your payment or the price or description of the Product is incorrect.
We refurbish and quality check every Product using our multi-point diagnostic process. Each Product page on the Site provides detailed information about the make, model, storage and cosmetic condition grade of the Product you are buying. Product images are for illustration purposes only. Whilst we make every effort to ensure that descriptions are accurate, minor variations may occur as a result of the refurbishment process or manufacturer updates.
All refurbished devices are graded to help you understand their cosmetic appearance. Each device is fully functional regardless of grade. Cosmetic grading is defined as follows:

Unless otherwise stated, your Product will arrive with a USB charging cable and generic packaging. Accessories such as power adapters, headphones and original boxes are only supplied if explicitly stated on the Product page. All software on the device will be reset to factory settings and any previous user data permanently removed.
All prices shown on the Site are in GBP and include VAT (where applicable). Delivery costs will be displayed before you confirm your order. We take payment at the point you place your order using the payment methods offered at checkout, which may include debit or credit card, PayPal, Klarna or Clearpay. By providing your payment details you confirm that you are authorised to use the chosen payment method. If your payment is not authorised, we will not be liable for any delay or non-delivery of the Product.
We deliver to UK addresses only. Delivery options and estimated timeframes will be displayed during checkout. Dispatch times may vary according to availability and any guarantees or representations made about delivery times are limited to the UK. We aim to deliver within the timeframe shown, but delays can occur outside of our control. Risk in the Product passes to you once delivered to the address you provided. Please check the packaging upon delivery and notify us promptly of any transit damage.
Where offered, you may choose to collect your Product from an Envirofone partner location. You must bring valid photo ID and a copy of your order confirmation. Products will be held for seven calendar days, after which the order will be cancelled and a refund issued to your original payment method.
If a product is found to be faulty or defective within 30 days of purchase, the consumer will be entitled to exercise their short-term right to reject the goods under applicable consumer law and receive a full refund. To qualify, the item must be returned complete, without additional damage caused by misuse, and include any accessories additionally purchased on the order.
For faults reported after 30 days from the date of purchase, remedies will be provided in accordance with applicable consumer law. The primary remedies will be repair or replacement. A refund will only be provided where a repair or replacement is not possible, has failed, is disproportionate in cost or inconvenience, or is otherwise required under applicable law.
Where a refund is due under statutory rights, the consumer will receive a refund of the price paid for the goods. We strongly recommend using a tracked and fully insured delivery service when returning items over the value of £500. We cannot accept liability for items lost or damaged in return transit where an alternative return method has been used, except where required by law or where our pre-paid return service is used.
Where an order is over £500 and the item is confirmed as faulty, we will reimburse reasonable return postage costs where a Royal Mail Special Delivery service (or equivalent tracked and insured service) has been used and the fault is confirmed.
Where our pre-paid Royal Mail Tracked 48 return service is used, any claim for loss remains subject to Royal Mail investigation and confirmation. A parcel may be treated as lost where there has been no tracking update within Royal Mail’s network for 10 days or more from the last recorded scan. Once loss is confirmed, we will provide a remedy in accordance with applicable consumer law, which may include a replacement like-for-like device or a refund.
For security and fraud prevention purposes, the IMEI number of each phone is recorded prior to dispatch and will be verified upon return to confirm that the original device has been returned.
We aim to complete inspection and processing of any approved repair, replacement, or refund within 7 working days of receipt of the returned item.
Every refurbished handset sold by Envirofone comes with a 12 month warranty against defects in materials and workmanship. Accessories and batteries are covered for 6 months. The warranty does not cover accidental damage (including screen cracks or liquid ingress), cosmetic wear, faults caused by unauthorised repairs, software modifications, malware or use with unauthorised accessories. If a fault occurs within the warranty period, contact us so we can diagnose the issue and arrange repair or replacement. You are responsible for safely returning the Product to us; we will cover the cost of sending it back to you.
All devices are supplied with manufacturer approved software at the time of sale. We are not responsible for subsequent software updates, network settings or compatibility issues with third party apps or accessories. You are responsible for backing up any data stored on the Product before returning it for any reason. We cannot recover or transfer data once a Product has been reset or repaired.
From time to time we may offer promotions that allow you to trade in an eligible device for money off a refurbished Product. Trade-in values are subject to inspection and acceptance of the device you send us. If your trade-in is rejected or the value is amended, we will contact you with your options. Promotional discounts linked to a trade-in may be cancelled or adjusted if you do not send your device, the device fails inspection or you return the refurbished Product for a refund.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be limited or excluded by law. Subject to that, we will not be liable for any loss of profit, loss of business, business interruption or loss of business opportunity. We are responsible for foreseeable loss or damage that you suffer as a result of us breaching these terms or failing to use reasonable care and skill, but we are not responsible for loss or damage that is not foreseeable.
We are not liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by an event outside our reasonable control. If such an event occurs we will contact you as soon as possible to let you know and take steps to minimise the effect. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any Products you have paid for but not received.

These terms and conditions are governed by English law. You can bring legal proceedings in respect of the Products in the English courts. If you live in Scotland you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or the English courts.
